How these figures are calculated: This calculator is powered by closed claims data from the Florida Office of Insurance Regulation. A closed claim is a medical malpractice lawsuit or written demand against a healthcare provider that has reached a final resolution through settlement, dismissal, or court judgment. Under Florida Statute 627.912, every insurer operating in Florida is required by law to report every closed malpractice claim to the state. All settlement values from 1994 through 2022 have been adjusted to 2026 dollars using the Bureau of Labor Statistics Medical Care Services Consumer Price Index (CPI Series CUUR0000SAM). Cases from 2023 onward reflect the post-cap removal landscape following North Broward Hospital District v. Kalitan. Pre-2023 settlements were constrained by the cap and may understate the value of comparable claims filed today.
